Quick answer
Are WhatsApp messages admissible as evidence in South Africa?
Yes. Under section 15 of the Electronic Communications and Transactions Act 25 of 2002 (the ECTA), a data message is admissible, and the court weighs it by how reliably it was generated and stored, the integrity of the information, and how the sender was identified. The CCMA and the Labour Court accept WhatsApp too. So the exhibit has to be authentic and complete, not a cropped screenshot. Export the whole conversation from WhatsApp (open the chat, use Export chat, include media), then have it certified: a line-numbered transcript, SHA-256 hashes, chain of custody and an independent timestamp.
Certification proves authenticity and integrity. It does not, on its own, cure a hearsay objection, which is a separate rule your legal representative deals with. What South African law says about WhatsApp evidence
Electronic messages are admissible, but they are not accepted at face value. Two things decide how far they carry: authentication, and, separately, the hearsay rule.
Admissible under the ECTA
Section 15 of the Electronic Communications and Transactions Act 2002 says a data message must not be denied as evidence merely because it is electronic or not in its original form.
Weight is about integrity
The court judges the weight by the reliability of how the message was generated, stored and communicated, the integrity of the information, and how the sender was identified. In S v Ndiki and Geldenhuys the courts admitted authenticated messages.
The hearsay question
A message put in to prove the truth of what it says can be hearsay, admitted under the Law of Evidence Amendment Act 45 of 1988 if it is in the interests of justice. Certification does not change that; it settles authenticity.

South African courts and the CCMA weigh how a message was generated and kept, whether its integrity held, and who sent it. What a preserved chat can prove in South Africa
With WhatsApp used by almost everyone, the evidence usually lives in a chat. It carries across the CCMA, the civil courts, the Labour Court and family matters.
Dismissal and misconduct (CCMA)
A dismissal sent by chat, a threatening or offensive message, or misconduct in a work group. The CCMA and Labour Court have accepted WhatsApp on both sides of a dismissal dispute.
A debt or an agreement
An acknowledgment of a debt, a promise to pay, or the terms of a deal struck over WhatsApp. The message where the other side admits the obligation is often the case.
Harassment and protection orders
Threatening or abusive messages support an application under the Protection from Harassment Act or the Domestic Violence Act. A certified record strengthens the application.
Divorce and family
In a divorce or a care and contact dispute, messages can evidence conduct, agreements or transfers. Preserve the full thread rather than selected screenshots.
Rental and deposits
Repairs you reported, a deposit, or a notice, for a dispute before the courts or the Rental Housing Tribunal. The chat shows what was agreed and when.
Defamation and cybercrime
Defamatory or unlawful messages, including offences under the Cybercrimes Act. If you are the target, a certified record supports a claim or a complaint.

Why a screenshot may not be enough
Take screenshots, they are a good first step. But a South African court weighs integrity and sender identity, and a bare screenshot answers neither.
Exports with metadata, device logs and an affidavit explaining how the evidence was obtained carry far more weight than an image. A cropped screenshot, stripped of its metadata, hash and provenance, is the easiest evidence for the other side to attack.
"It could have been edited"
Fake-chat generators can produce a convincing conversation in seconds, so a bare screenshot invites the claim that you altered it. A SHA-256 hash and a signed manifest answer the integrity question.
Who sent it
The court wants the sender identified. A preserved export, and the message database if you send it, keep the identifiers that support attribution far better than an image.
No provable date
A screenshot has no independent timestamp. A qualified timestamp and a Bitcoin anchor fix when the messages existed, which matters when the sequence is disputed.
Only a fragment
A single message can be taken out of context. A full export shows the whole exchange in order, which is harder to dismiss and closer to the reliable record the court prefers.

How to export the WhatsApp chat
WhatsApp has a built-in per-chat export on your phone (iPhone and Android) and in the WhatsApp Desktop app (Mac and Windows). Choose to include media, and send us that export.
On a computer, in WhatsApp Desktop (Mac and Windows)

In the WhatsApp Desktop app on Mac or Windows, this is the quickest route:
- 1Right-click the conversation in your chat list (or click the chevron that appears on hover), then click Export chat.
- 2Choose Attach media (recommended) or Without media.
- 3The file is saved straight to your Downloads folder (a message confirms "Exported chat was saved to Downloads folder"). Send us that .zip.
You get the same _chat.txt plus media as the phone export. Desktop is easiest when the chat is already on your computer, or is too large to email from a phone.
On your phone (iPhone and Android)
Export from your phone
On iPhone: open the chat, then:

- 3Choose Attach media, then Save to Files.
On Android: open the chat, then:

Export chat greyed out or missing?
Two things can hide the in-app Export chat. It is unavailable in a few regions, and it is disabled when Advanced Chat Privacy is turned on for that chat. Turn Advanced Chat Privacy off and export again, use a device backup, or email us and we will guide you.

Send us everything (recommended)
The primary artifact is the _chat.txt export plus its media folder. For the strongest exhibit, if available also send the WhatsApp message database, which can sometimes still hold recently deleted messages and keeps the sender identifiers that support attribution. We seal whatever you send, hashed and timestamped, never opened. If authenticity is ever disputed, a court-appointed expert can verify the transcript against the source. Decrypting the database needs its key, which the custodian provides separately.

Two layers of proof, and what each one means
Both layers are included in every certification. In a South African court they are independent corroboration of the date and integrity the ECTA asks about.
Bitcoin OpenTimestamps
The SHA-256 hash of your sealed manifest is anchored in the Bitcoin blockchain: a decentralised, independent, tamper-resistant proof that the export existed at a point in time. The court weighs it as part of the evidence.
eIDAS qualified timestamp
Independent corroboration
Issued by Disig a.s., a Qualified Trust Service Provider on the EU Trusted List. It is an EU qualified timestamp, so in a South African court it stands as strong, independent proof of the date and integrity, alongside the hash and chain of custody.
What certification proves, and what it does not
What certification proves
- The export existed in that exact state no later than the timestamp.
- It has not been altered since it was sealed.
- The raw export is preserved for later expert examination.
- If you also send the sealed message database, an expert can examine the sender identifiers, which materially strengthens attribution.
What it does not do
- It does not, on its own, cure a hearsay objection; that is a separate rule the court applies.
- It does not decide your case or replace a legal representative; the court or commissioner decides.
- On its own it ties messages to an account, not conclusively to a named person; the court decides authorship.
