Are WhatsApp messages valid evidence in UAE courts?

Yes. Under the UAE Evidence Law (Federal Decree-Law No. 35 of 2022), electronic messages such as WhatsApp are admissible and carry the same weight as written evidence, and an extracted message is treated as the original, challengeable only by an allegation of forgery. Courts still examine authenticity, the sender's identity and the integrity of the messages, so the exhibit has to be preserved and verifiable. Export the whole conversation from WhatsApp (open the chat, use Export chat, include media), then have it certified: a line-numbered transcript, SHA-256 hashes, chain of custody and an independent qualified timestamp, which directly answers a forgery challenge.

What the UAE Evidence Law says about WhatsApp

The rules are unusually clear, and unusually favourable to a well-preserved chat. They are set out in Federal Decree-Law No. 35 of 2022 on Evidence in Civil and Commercial Transactions.

Same weight as written proof

Information exchanged by electronic means is admissible, and the law gives it the same evidentiary weight as written evidence. A WhatsApp chat is not a second-class exhibit.

An extract is the original

UAE courts have held that an extracted WhatsApp message is treated as the original document. You cannot be forced to produce anything more, and the only permissible challenge is an allegation of forgery.

What the court still checks

Messages are not accepted at face value. The court examines authenticity, the sender's identity, usually via the mobile number, and the integrity of the messages. That is precisely what certification proves.

Real UAE rulings

Courts have ordered debts repaid on WhatsApp alone

A Dubai court ordered two brothers to repay a loan on the strength of WhatsApp messages, and in a separate case reported in 2025 a Dubai court ordered around AED 480,000 in personal debt repaid after accepting WhatsApp messages in which the borrower acknowledged the debt. The lesson is consistent: the message where the other side admits the obligation is the case.

But not at face value. As UAE lawyers stress, WhatsApp texts must be verified to be accepted, so how you preserve and authenticate the chat decides how much weight it carries.

What a preserved chat can prove in the UAE

WhatsApp is where much of life and business in the Emirates happens, so it is where the evidence lives. UAE courts accept it across civil, commercial, employment and family disputes.

A debt or a loan

An acknowledgment of a debt and a promise to repay is powerful evidence, and UAE courts have ordered repayment on exactly that. Preserve the admission and any repayment plan.

A commercial agreement

Price, scope, delivery and terms are often agreed over WhatsApp. The chat shows what was agreed and by whom when a deal later goes wrong.

An employment dispute

Instructions, a promised bonus, overtime, a dismissal or misconduct communicated by chat. Preserve the messages that show what was said and when.

A tenancy dispute

Rent, a deposit, maintenance you reported, or a notice to vacate. A preserved chat supports a rental dispute before the courts or a rental committee.

A family matter

In a personal status case, messages can evidence agreements, transfers or conduct. Preserve the full thread rather than selected screenshots.

Threats and defamation

If you are the target of threats or defamatory messages, a certified record supports a complaint. Preserve it, and take legal advice before you act.

Why a screenshot is risky in a UAE court

Take screenshots, they are a good first step. But in the UAE the only way to attack an extracted message is to allege forgery, and a bare screenshot is the easiest thing to attack that way.

The court weighs authenticity, sender identity and integrity. A screenshot, stripped of its metadata, hash and provenance, gives the other side an open invitation to cry forgery. Certification closes that door.

The forgery allegation

Fake-chat generators can produce a convincing conversation in seconds, so a bare screenshot makes a forgery claim easy. A SHA-256 hash and a signed manifest let you prove the export is unaltered.

Sender identity

The court wants to tie the messages to a person, usually through the mobile number. A preserved export, and the message database if you send it, keep the identifiers that support attribution.

No provable date

A screenshot has no independent timestamp. A qualified timestamp and a Bitcoin anchor fix when the messages existed, which matters when the sequence is disputed.

Only a fragment

A single message can be spun out of context. A full export shows the whole exchange in order, which is harder to dismiss and closer to the original the law prefers.

Onshore, DIFC or ADGM, and the language of the court

The onshore courts of Dubai, Abu Dhabi and the other Emirates conduct proceedings in Arabic and generally require a certified legal translation of documentary evidence, often with a technical report showing the messages have not been tampered with. How to export the WhatsApp chat

WhatsApp has a built-in per-chat export on your phone (iPhone and Android) and in the WhatsApp Desktop app (Mac and Windows). Choose to include media, and send us that export.

On a computer, in WhatsApp Desktop (Mac and Windows)

Export from WhatsApp Desktop

In the WhatsApp Desktop app on Mac or Windows, this is the quickest route:

  1. 1Right-click the conversation in your chat list (or click the chevron that appears on hover), then click Export chat.
  2. 2Choose Attach media (recommended) or Without media.
  3. 3The file is saved straight to your Downloads folder (a message confirms "Exported chat was saved to Downloads folder"). Send us that .zip.

You get the same _chat.txt plus media as the phone export. Desktop is easiest when the chat is already on your computer, or is too large to email from a phone.

On your phone (iPhone and Android)

Export from your phone

On iPhone: open the chat, then:

  1. 1Tap the contact or number at the top to open contact info.
  2. 2Scroll down and tap Export chat.
  3. 3Choose Attach media, then Save to Files.

On Android: open the chat, then:

  1. 1Tap More options (the three-dot menu at the top right).

Export chat greyed out or missing?

Two things can hide the in-app Export chat. It is unavailable in a few regions, and it is disabled when Advanced Chat Privacy is turned on for that chat. Turn Advanced Chat Privacy off and export again, use a device backup, or email us and we will guide you.

Send us everything (recommended)

The primary artifact is the _chat.txt export plus its media folder. For the strongest exhibit, if available also send the WhatsApp message database, which can sometimes still hold recently deleted messages and keeps the sender identifiers that support attribution. We seal whatever you send, hashed and timestamped, never opened. If forgery is ever alleged, a court-appointed expert can verify the transcript against the source. Decrypting the database needs its key, which the custodian provides separately.

Encrypting the backup is what keeps the WhatsApp data complete.

Two layers of proof, and what each one means in the UAE

Both layers are included in every certification. In a UAE court they are independent corroboration of date and integrity, which is exactly what the Evidence Law examines.

Bitcoin OpenTimestamps

The SHA-256 hash of your sealed manifest is anchored in the Bitcoin blockchain: a decentralised, independent, tamper-resistant proof that the export existed at a point in time. A UAE court weighs it as part of the evidence.

eIDAS qualified timestamp

Independent corroboration

Issued by Disig a.s., a Qualified Trust Service Provider on the EU Trusted List. It is an EU qualified timestamp, not a UAE one, so in a UAE court it stands as strong, independent proof of the date and integrity, alongside the hash and chain of custody.

What certification proves, and what it does not

What certification proves

  • The export existed in that exact state no later than the timestamp.
  • It has not been altered since it was sealed, which directly answers a forgery allegation.
  • The raw export is preserved for later expert examination.
  • If you also send the sealed message database, an expert can examine the sender identifiers, which materially strengthens attribution.

What it does not do

  • It does not decide your case or replace a UAE advocate; the court decides.
  • It is an EU qualified timestamp, not a UAE-issued qualified electronic time stamp under Decree-Law 46/2021.
  • On its own it ties messages to an account, not conclusively to a named person; the court decides authorship.
