Are WhatsApp screenshots admissible in court? Yes, but rarely on their own.

Under FRE 901(b)(1) you must produce evidence sufficient to support a finding that the item is what you claim, and a screenshot alone often fails, so federal courts expect metadata and corroboration. FRE 902(14) lets certified data copied from an electronic device self-authenticate when accompanied by a hash and disclosed with notice, typically 14 days before trial.

A certified export with a SHA-256 hash and a custodian declaration is built for the 902(14) path.

The Civil Evidence Act 1995 admits documents, defined as anything in which information is recorded, and a statement may be proved by an authenticated copy however many removes from the original. The court then weighs reliability, and the Civil Procedure Rules expect electronic evidence in a form it can rely on, so judges increasingly ask for the underlying data, not a screenshot.

Weight is assessed on reliability, which a certified, authenticated export directly supports.

Electronic evidence is admitted under each member state's rules, but an eIDAS qualified timestamp carries a presumption of accuracy of the date and integrity of the data under Article 41(2). That presumption is something a screenshot can never offer.

Electronic records are governed by the Bharatiya Sakshya Adhiniyam 2023, in force since 1 July 2024, which replaced the old Section 65B certificate regime. Under Section 63 an electronic record must come with a certificate and, as a precondition, its SHA-256 hash value. Trial-court data shows most electronic evidence is now rejected for a missing hash, not a missing certificate, so a bare screenshot with no hash is worth little.

Under Federal Decree-Law No. 35 of 2022 on Evidence, information exchanged by electronic means is admissible and carries the same weight as written evidence. Dubai courts have treated an extracted WhatsApp message as the original, open to challenge only by an allegation of forgery, provided it is kept in its original state to rule out manipulation.

WhatsApp chats are computer-generated documents under Section 84 of the Evidence Act 2011. They are admissible if the device was in regular use and working properly, and Section 84(4) allows a certificate of compliance in place of a witness. A screenshot on its own rarely satisfies those conditions.

Under the Electronic Communications and Transactions Act 2002, a data message must not be denied as evidence just because it is electronic or not in its original form. In S v Ndiki and later cases the courts admitted electronic messages once authenticated, weighing how the message was generated, how its integrity was kept, and how the sender was identified.

Under Section 7 of the Electronic Transactions Act 2008 (Act 772), an electronic record cannot be denied admissibility just because it is electronic. The court weighs its value by the reliability of how it was generated and stored, how its integrity was kept, and how its originator was identified.
