What kinds of WhatsApp messages matter most in divorce and custody?

The recurring ones are: admissions of infidelity; evidence of hidden income, undisclosed bonuses, transfers or large purchases relevant to the financial settlement; parental alienation, such as negative messages about the other parent or coaching a child; missed contact and breaches of a visitation arrangement; and patterns of coercive or controlling behavior and intimidation over time. A full, unaltered thread that shows the sequence and timing is far more persuasive than a single cherry-picked line.

How do I export the WhatsApp chat to give to my lawyer?

WhatsApp has a built-in per-chat export. On Android, open the chat, tap More options (the three-dot menu), then More, then Export chat, and choose Include media. On iPhone, tap the contact or group name at the top, scroll down, tap Export chat, choose Attach media and Save to Files. On WhatsApp Desktop (Mac or Windows), right-click the conversation in your chat list, click Export chat, then choose Attach media. You get a .zip with a _chat.txt file plus the media. The in-app export is disabled when Advanced Chat Privacy is on for a chat; in that case turn it off, use a device backup or email us.

Do I need to print the WhatsApp conversation for a custody dispute?

Usually yes: lawyers and courts need a document they can file or put in the bundle, so you will want a printable version. A plain printout is only a screenshot on paper, though. It carries no hash, no reliable date and no proof that the thread is complete. Why a screenshot will not hold up in family court

You may already hold the decisive message. The problem is the form it is in. The other side increasingly argues a screenshot was edited or generated with a fake-chat tool. Certification answers all four weaknesses.

Under FRE 901 (and the state rules modeled on it) in the US you must show the item is what you claim it is, and courts usually prefer a complete message history over selected extracts. A screenshot, stripped of metadata, hash and provenance, rarely clears that bar on its own.

One setting can hide the in-app Export chat: it is disabled when Advanced Chat Privacy is turned on for that chat, and in a group only an admin can switch it off. Turn Advanced Chat Privacy off (or ask the admin) and export again, use a device backup, or email us and we will guide you.

Admissibility and final authorship are decided by the court.
