Section 146 of the Evidence Act 1995 presumes that a device or process which ordinarily produces a particular outcome did so on the occasion in question. That presumption is rebuttable, so the practical question is how well the capture documents itself, which is exactly what a hash, a signature and an independent timestamp answer. Note that section 147, the business-records equivalent, will not help here: subsection (3) excludes documents produced for or in contemplation of a proceeding, which is what a capture made for a dispute is. Section 146 is the provision that does the work. Are screenshots admissible in an Australian court?

Courts overseas have knocked back screenshot evidence on authentication grounds in United States v Vayner and Griffin v State. The gap they identified is the same one here.

No timestamp proof

The presumption of accuracy of the date

ProofSnap's eIDAS qualified timestamps carry a statutory presumption. Under EU Regulation 910/2014 the date and time a qualified timestamp indicates, and the integrity of the data bound to them, are presumed accurate. The presumption is rebuttable, and it arises in EU member state courts.

Which evidence rules apply where you are filing

Australia never finished harmonising its evidence law, so the rule that helps you depends on the forum. The practical effect is the same everywhere: nobody has to accept a bare image file, and a record that documents its own integrity is worth more than one that does not.

Uniform Evidence Acts

Commonwealth, NSW, Victoria, Tasmania, the ACT and the Northern Territory. Section 146 presumes that a process or device which ordinarily produces a given outcome did so this time. The presumption is rebuttable, which is where the hash and the timestamp earn their keep. Section 147, the business-records equivalent, is no help for a litigation capture: subsection (3) excludes documents made for or in contemplation of a proceeding.

Queensland, WA, South Australia

Outside the uniform scheme, each applying its own Evidence Act. The authentication question is put differently, but it is still the same question: can you show the record is what you say it is, and that it has not changed since.

Tribunals: NCAT, VCAT, QCAT and the rest

Not bound by the rules of evidence, so your screenshot gets in. Getting in is not the same as being believed. A member deciding between two accounts will prefer the one that can be independently verified in a browser.

Electronic Transactions Act 1999

Confirms that electronic form and electronic signatures satisfy legal requirements, provided the method identifies the signer and is as reliable as appropriate in the circumstances. States and territories have their own mirror Acts.

An honest note on eIDAS: Australia has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in an Australian court. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.
