Why screenshot evidence gets challenged

A screenshot is not rejected for being a screenshot. It is rejected, or given no weight, when nobody can tie it to a source or a time, or show that the process it came from was working.

No timestamp proof

File timestamps can be changed in seconds. Courts know this. Without a blockchain or eIDAS-qualified timestamp, you can't prove when you captured it.

No tampering detection

Any screenshot can be edited with AI. In Mendones v Cushman & Wakefield (Alameda County Superior Court, 9 September 2025) the case was dismissed with prejudice after the judge found the plaintiffs had filed AI-altered videos and images. Without a SHA-256 hash, there's no way to prove yours is real.

No chain of custody

Who captured it? When? On what device? How was it stored? Screenshots don't answer any of these questions. Section 137 presumes a technical process did what it is asserted to have done only where the process is of a kind that ordinarily does it.

Defamation: two years, and no notice required

Unlike Australia, New Zealand requires no pre-action notice and imposes no statutory serious harm threshold, and the primary limitation period runs two years from publication under the Limitation Act 2010. You still have to prove what was published, by whom, and how far it spread. Capture the post, the account and the reach while the page is live, because a deleted post is a deleted case. Netsafe and the HDCA

Netsafe is the Approved Agency for complaints under the Harmful Digital Communications Act, and the District Court can order material taken down, order the conduct to stop, or order a correction or an apology. The Netsafe complaint and the court application both need proof of the communication, and it often vanishes while you are still filling in the form. How a New Zealand court tests your evidence

New Zealand deals with this in one statute, where Australia splits the same question between a uniform scheme and the states that stayed outside it. Under section 137 of the Evidence Act 2006, where evidence is produced wholly or partly by a machine, device or technical process of a kind that ordinarily does what it is asserted to have done, the court presumes it did so on that occasion, in the absence of evidence to the contrary. A ProofSnap package exists to show the process is of that kind, and to leave the other side something they can actually test.

Section 137 turns on three questions, and they are asked in this order.

  1. Was the evidence produced by a machine, device or technical process? A browser capture is, and so is a plain screenshot. This step is rarely where anything is won or lost.
  2. Is that process of a kind that ordinarily does what you say it did? This is the real test. The forensic log and the chain of custody describe the process step by step, so the court is looking at a documented method rather than an assertion.
  3. Is there evidence to the contrary? The presumption holds until the other side puts something against it. A SHA-256 hash, an RSA-4096 signature and a Bitcoin timestamp are what they have to argue with, and all three can be checked without us.

One country, one evidence statute

New Zealand is simpler than Australia here, and that is worth knowing if you have been reading Australian material. There is no state-by-state split and no separate uniform scheme to check. One Act applies, and the forum decides how formally it is applied.

Where evidence is produced by a machine, device or technical process of a kind that ordinarily does what you assert it does, it is presumed to have done so on the occasion in question, in the absence of evidence to the contrary. That last phrase is the whole game: the presumption holds until someone gives the court a reason to doubt it.

Tribunals: no formal rules of evidence

The Disputes Tribunal decides on the merits rather than on technicalities, and lawyers appear only in limited circumstances. The Tenancy Tribunal works informally too, on the merits, without formal rules of evidence. Material gets in freely, so weight is the only battleground.

Deadlines differ sharply from Australia

A personal grievance must be raised within 90 days, or within 12 months where it is based on sexual harassment. A defamation claim runs two years from publication. Neither matches the Australian timeframes, so do not work from Australian guidance.

An honest note on eIDAS: New Zealand has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in a New Zealand court or tribunal. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.
