Sept 2025: A California judge threw out a case, the video evidence was a deepfake. Is your evidence tamper-proof?

ProofSnap Chrome extension side panel, capture page snapshot, record video, EU qualified timestamp (eIDAS), and Trust Verifier

ProofSnap is a Chrome & Edge extension that captures web pages as court-admissible evidence in 41 seconds. Three capture options: single page, multi-tab browsing session (with per-tab forensic packages), or signed video proof (Auto, Manual, or Session-wide screen recording). Every capture includes a SHA-256 cryptographic hash, RSA-4096 digital signature, Bitcoin blockchain timestamp via OpenTimestamps, and a Provenance Certificate with 8 integrity checks for deepfake detection. In New Zealand, this speaks directly to section 137 of the Evidence Act 2006: where a machine, device or technical process generally does what a party asserts it does, it is presumed to have done so on the occasion in question, in the absence of evidence to the contrary. New Zealand runs one national evidence statute rather than a state-by-state patchwork, so the same test applies wherever you file. The presumption can still be displaced, which is why it matters how well the capture documents itself, and that is exactly what a hash, a signature and an independent timestamp answer. Our guide to tribunal evidence works through this in detail. The same signed package strengthens a Disputes Tribunal or Tenancy Tribunal application, a defamation claim under the Defamation Act 1992, a complaint to Netsafe under the Harmful Digital Communications Act, or a report to the National Cyber Security Centre. Enterprise plans add eIDAS-qualified timestamps issued by Disig a.s., a Qualified Trust Service Provider on the EU Trusted List, for extra international weight. Evidence packages also line up with FRE 901 (US), eIDAS Article 41 (EU) and comparable rules in Germany, Italy and France. Pricing starts at $8.99/month with a 7-day free trial requiring a credit card. Used by lawyers, STR hosts, copyright enforcement firms, and compliance teams in 23 countries.

Why courts reject screenshots

United States courts rejected screenshot evidence in US v. Vayner, Griffin v. State and Serrano v. Cruz-Angeles. The authentication gap they identified is the same one here.

No timestamp proof

File timestamps can be changed in seconds. Courts know this. Without a blockchain or eIDAS-qualified timestamp, you can't prove when you captured it.

No tampering detection

Any screenshot can be edited in 10 seconds with AI. In Sept 2025, a California judge dismissed a case after discovering deepfaked video evidence. Without a SHA-256 hash, there's no way to prove yours is real.

No chain of custody

Who captured it? When? On what device? How was it stored? Screenshots don't answer any of these questions. Under FRE 901 and eIDAS Art. 41, digital evidence requires authentication.

Your screenshot

  • 1 JPEG file, no proof it's real
  • No timestamp, could have been taken anytime
  • Editable in Photoshop in 10 seconds
  • "Anyone could have made this", judge

ProofSnap evidence package

  • Up to 15 files, screenshot, HTML, metadata, forensic log
  • Blockchain timestamp, immutable proof of when
  • Video of capture + Provenance Certificate
  • Chain of custody, court-ready under FRE 901

Built for how disputes start in New Zealand

Capture it before they delete it

Most New Zealand disputes never reach the High Court. They start at the Disputes Tribunal or the Tenancy Tribunal, with a personal grievance raised inside 90 days, or with a post that disappears the moment someone lawyers up. The National Cyber Security Centre recorded NZ$5.6 million in direct losses in the first quarter of 2026 alone. Whether you are filing a tribunal application, raising a grievance, or complaining to Netsafe, ProofSnap locks the record in seconds, with a signed PDF and a SHA-256 hash that holds up when the other side says "that screenshot is fake".

Disputes & Tenancy Tribunal claims

Tenancy, building, vehicle and consumer disputes are decided on listings, inspection photos and message threads. The Disputes Tribunal limit rose to NZ$60,000 on 24 January 2026 and follows no formal rules of evidence, so a referee weighs whose account to prefer. A landlord or trader who says the listing never said that is much harder to believe against a hashed, timestamped capture. See the detail in our guide to Disputes and Tenancy Tribunal evidence.

Defamation: two years, and no notice required

New Zealand gives you two years from publication and, unlike Australia, requires no pre-action notice and imposes no statutory serious harm threshold. The courts here work with a more-than-minor-harm test instead. You still have to prove what was published, by whom, and how far it spread. Capture the post, the account and the reach while the page is live, because a deleted post is a deleted case. See our guide to defamation evidence in New Zealand.

Netsafe and the HDCA

Netsafe is the Approved Agency for complaints under the Harmful Digital Communications Act, and the District Court can order material taken down, order the conduct to stop, or order a correction or an apology. Both steps need proof of the communication, and it often vanishes while you are still filling in the form. Capture it first, complain second, as explained in our guide to Netsafe and HDCA evidence.

E-shop, Trade Me & investment scams

The NCSC recorded NZ$5.6 million in direct losses in the first quarter of 2026, and the security vendor Gen reports e-shop scams up 87 per cent across the first half of the year. Lock the listing, the price, the promised delivery, the fake dashboard and the chat before the account disappears, so your bank dispute and your reports to the NCSC and Netsafe all rest on the same signed package. Our guide to scam evidence in New Zealand sets out what to capture and in what order.

Just one dispute? You do not need a subscription.

If you are dealing with a single scam or one bad actor, a one-off SnapPack is a single up-front purchase, with no subscription, no auto-renewal, and no trial. Or send us the link and our team captures the court-ready package for you, no install required.

Guides for New Zealand matters

Pick the forum you are dealing with

Each guide covers the deadlines that apply, what the decision maker is actually weighing, and what to capture first.

Australia splits its evidence law between a uniform scheme and three states that opted out, and its deadlines are shorter. If your matter is there, see ProofSnap in Australia. For the Republic of Ireland, see ProofSnap in Ireland, where a qualified timestamp carries an eIDAS presumption rather than mere corroboration.

Official New Zealand sources

The legal framing on this page rests on the following primary sources. Check them rather than taking our word for it.

Don't trust us. Trust the maths.

Three vendor approaches. One critical difference.

Most web-evidence tools force you to depend on them. ProofSnap evidence is self-verifiable: anyone with the ZIP can confirm authenticity using open standards (SHA-256, OpenTimestamps, eIDAS), with or without ProofSnap continuing to exist.

ProofSnap Page Vault / Pagefreezer Notary / Wayback Machine
Verifiable without the vendor? Yes, SHA-256 + OpenTimestamps work forever No, verification requires their portal No, depends on archive availability
What if the vendor disappears? Evidence still valid Evidence becomes hard to defend Wayback can be wiped on request
Independent court-expert verification Any IT expert, in 60 seconds Requires vendor cooperation Requires manual screenshot
Cryptographic proof in the file itself Yes, open standards (SHA-256, OTS, eIDAS) Proprietary format None
“Its merit is based on it being self-verifiable, and not necessarily dependent on the credit or level of trust afforded to the company or institution behind it.”

Video of Capture

capture_video.webm

Screen recording included in the evidence package, three modes:

  • Auto: records the capture process (~60s), page scroll, screenshots, metadata extraction.
  • Manual: press Start before playing media on the page (live stream, infringer video, deepfake), Stop & Capture when done. Up to 5 min on Essential / Pro, 10 min on Enterprise / Company.
  • Session: multi-tab. Records continuously while you browse across multiple tabs, then bundles a per-tab forensic package for every visited tab (full-page screenshot, HTML, DOM, DNS, WHOIS, TLS, signed evidence.pdf) into one signed ZIP.

All three modes hash the recorded video into the signed manifest, any single-frame change breaks the signature. Available on all plans.

SESSION CAPTURE

Multi-tab forensics in one ZIP

Record across tabs. Every visited http(s) tab gets its own forensic folder (screenshot, HTML, DOM, DNS, WHOIS, TLS, signed evidence.pdf) inside a single signed, blockchain-timestamped ZIP with a session-wide video.

Use cases: multi-platform fraud, IP theft across domains, employment claims, regulator portal audits.

The burden of proof, reversed

ProofSnap's eIDAS qualified timestamps shift the legal burden. Under EU Regulation 910/2014, Article 41, your evidence is legally presumed accurate, and the opposing party must prove otherwise.

With ProofSnap eIDAS timestamp

  • Opponent must prove your evidence is fake
  • Legal presumption of accuracy (eIDAS Art. 41)
  • Automatically recognised in all 27 EU member states
  • No expert witness needed to explain the technology
  • Dual timestamp: eIDAS qualified + Bitcoin blockchain

Regular screenshot or blockchain-only

  • You must prove your evidence is real
  • No legal presumption, judge decides case by case
  • Court recognition varies by country
  • May need expert witness to explain blockchain
  • Deepfake objection can invalidate entire evidence

One country, one evidence statute

New Zealand is simpler than Australia here, and that is worth knowing if you have been reading Australian material. There is no state-by-state split and no separate uniform scheme to check. One Act applies, and the forum decides how formally it is applied.

Evidence Act 2006, section 137

Where a machine, device or technical process generally does what you assert it does, it is presumed to have done so on the occasion in question, in the absence of evidence to the contrary. That last phrase is the whole game: the presumption holds until someone gives the court a reason to doubt it.

Tribunals: no formal rules of evidence

The Disputes Tribunal decides on the substantial merits and justice of the case, having regard to the law but not bound by strict legal rights or technicalities, and allows no lawyers in all but limited circumstances. The Tenancy Tribunal works informally too, under the general principles of the law and the substantial merits and justice of the case. Material gets in freely, so weight is the only battleground.

Contract and Commercial Law Act 2017

Part 4 replaced the Electronic Transactions Act 2002. Under section 226 an electronic signature, other than a witness signature, satisfies a legal requirement if it adequately identifies the signatory, adequately indicates their approval, and is as reliable as appropriate for the purpose. Where the information has to be given to someone, that person must also consent to receiving an electronic signature. Schedule 5 still excludes wills and affidavits, and since 30 March 2025 the exclusion for powers of attorney no longer applies to a deed creating a power of attorney in connection with a security interest.

Deadlines differ sharply from Australia

A personal grievance is raised within 90 days, or 12 months where it is based on sexual harassment. A defamation claim runs two years from publication. Neither matches the Australian timeframes, so do not work from Australian guidance.

An honest note on eIDAS: New Zealand has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in a New Zealand court or tribunal. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.

Prices are charged in USD. The approximate New Zealand figure shown under each price is for orientation only, converted at about NZ$1.73 to US$1. Your card issuer sets the actual rate on the day.
