How does blockchain timestamping work in ProofSnap?

Are screenshots admissible as evidence in court?

Regular screenshots can be challenged in court because they carry no proof of when they were taken or whether they have been altered. Canadian law is unusually direct about this. Under section 31.1 of the Canada Evidence Act the burden of proving authenticity sits on whoever tenders the electronic document, and section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system that recorded or stored it. Section 31.3 adds that integrity is proven, in the absence of evidence to the contrary, by evidence that the system was operating properly at all material times. Every province has its own Evidence Act built from the same uniform model, and Ontario section 34.1 goes further by expressly recognizing reliable encryption as a way of supporting integrity. Tribunals such as the Landlord and Tenant Board and the Civil Resolution Tribunal do not apply the rules of evidence strictly, but they still weigh how reliable a record looks, and the LTB will refuse material filed late. ProofSnap addresses this by creating a forensic evidence package containing a SHA-256 hash proving the content has not been modified, an RSA-4096 digital signature for authenticity, a blockchain timestamp proving when the capture happened, and full metadata including the URL and the capture time in UTC. That is a direct answer to the section 31.2 integrity question, and it gives an adjudicator something concrete to weigh rather than an image file with no provenance.

What makes ProofSnap evidence tamper-proof?

ProofSnap uses three layers of cryptographic protection: SHA-256 Hashing: Every file in the evidence package is hashed. Changing even a single pixel or character produces a completely different hash, making any tampering immediately detectable. Digital Signature: The manifest (listing all files and their hashes) is digitally signed with a private key. The corresponding public key is included for anyone to verify authenticity. Blockchain Timestamp: The manifest hash is anchored to the Bitcoin blockchain via OpenTimestamps, creating an immutable record of when the evidence was captured. This timestamp cannot be forged or backdated. Together, these mechanisms create a chain of integrity that proves the evidence is authentic, unaltered, and was captured at a specific point in time.

How does eIDAS 2 affect digital evidence in 2026?

The eIDAS 2 regulation (EU 2024/1183) is fully rolling out by the end of 2026, establishing stricter standards for electronic identification, digital signatures, and qualified electronic timestamps across all EU member states. Under Article 41 , qualified electronic timestamps enjoy a legal presumption of accuracy for the date and time they indicate, and the integrity of the data to which the timestamp is linked. This means evidence timestamped with a qualified service is admissible across all EU courts. Two layers of evidence law, one question

Canada has a federal Evidence Act and a provincial one in every province, all drafted from the same uniform model. The statute that applies depends on the court, but the question they put to an electronic document is the same one, and it is unusually close to what a cryptographic capture is designed to answer.

Authenticity is your burden

Section 31.1 of the Canada Evidence Act puts the burden of proving authenticity on the party seeking to admit the electronic document, by evidence capable of supporting a finding that it is what it is purported to be. Nobody has to disprove your screenshot. You have to prove it.

Best evidence turns on system integrity

Section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system that recorded or stored the document. Section 31.3 says integrity is proven, absent evidence to the contrary, by evidence the system was operating properly at all material times.

The provinces mirror it

Ontario section 34.1 of the Evidence Act satisfies the best evidence rule on proof of the integrity of the electronic record, and expressly allows that integrity to be supported by evidence that reliable encryption techniques were used. Other provinces follow the same uniform model.

Tribunals are looser, deadlines are not

The Landlord and Tenant Board and the Civil Resolution Tribunal do not apply the rules of evidence strictly, but the LTB will refuse late material: 7 days before the hearing for the evidence you rely on, 5 days for responding evidence, and portal upload is not service.

An honest note on eIDAS: Canada has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in a Canadian court or tribunal. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.
