A screenshot is not excluded simply because it is a screenshot. It is refused when nobody can tie it to a source or a time, or show that the system it came from was working. Canadian law puts that gap in writing: the burden of proving authenticity is on the party tendering the document.

File timestamps can be changed in seconds. Courts know this. Without a blockchain or eIDAS-qualified timestamp, you can’t prove when you captured it.
Any screenshot can be edited with AI. In Mendones v. Cushman & Wakefield (Alameda County Superior Court, September 9, 2025), a California case, and no authority here, the claim was dismissed with prejudice after the judge found the plaintiffs had filed AI-altered videos and images. Without a SHA-256 hash, there’s no way to prove yours is real.
Who captured it? When? On what device? How was it stored? A screenshot answers none of these questions. Under section 31.1 of the Canada Evidence Act, an electronic document has to be authenticated by whoever tenders it.

A defendant can move early under section 137.1 of the Courts of Justice Act to dismiss a claim arising from expression on a matter of public interest, and the burden then flips to you: substantial merit, no valid defence, and harm outweighing the public interest in the expression, all before discovery. British Columbia lets you apply online to the Civil Resolution Tribunal for an order that an intimate image be deleted, de-indexed or removed, and since March 18, 2026 you can seek up to C$75,000 in compensation rather than C$5,000. Canada has a federal Evidence Act and the common law provinces have their own, most of them drafted from the same uniform model. Quebec is different: proof there runs on the Civil Code and on Quebec's own information technology statute. The statute that applies depends on the court, but the question they put to an electronic document is the same one, and it is unusually close to what a cryptographic capture is designed to answer.
Authenticity is your burden
Section 31.1 of the Canada Evidence Act puts the burden of proving authenticity on the party seeking to admit the electronic document, by evidence capable of supporting a finding that it is what it is purported to be. Nobody has to disprove your screenshot. You have to prove it.
Best evidence turns on system integrity
Section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system that recorded or stored the document. Section 31.3 proves that integrity, absent evidence to the contrary, on evidence capable of supporting a finding that the system was operating properly at all material times.
The provinces mirror it
section 34.1 of the Ontario Evidence Act satisfies the best evidence rule on proof of the integrity of the electronic record, and expressly allows that integrity to be supported by evidence that reliable encryption techniques were used. Other provinces follow the same uniform model.
Tribunals are looser, deadlines are not
The Landlord and Tenant Board and the Civil Resolution Tribunal do not apply the rules of evidence strictly, but the LTB will refuse late material: 7 days before the hearing for the evidence you rely on, 5 days for responding evidence, and uploading to the portal does not count as serving the other party.
Where eIDAS fits in Canada: Canada has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in a Canadian court or tribunal. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.

The eIDAS 2 regulation (EU 2024/1183) will be fully in force by the end of 2026, establishing stricter standards for electronic identification, digital signatures, and qualified electronic timestamps across all EU member states.
Under Article 41(2), a qualified electronic timestamp carries a presumption of the accuracy of the date and time it indicates and of the integrity of the data it is linked to. Article 41(1) prevents such a timestamp being denied legal effect merely because it is electronic. Neither paragraph makes any item of evidence admissible; that stays a question for the court hearing the case, and in Canada it is the integrity test of the Canada Evidence Act.
