September 2025: A California judge threw out a case after finding the video evidence was a deepfake. Is your evidence tamper-evident?

Screenshots get challenged in court.
ProofSnap evidence gets checked.

ProofSnap is a Chrome and Edge extension that captures a web page as evidence for Canadian courts and tribunals. Every capture carries a SHA-256 hash and an RSA-4096 signature, with a Bitcoin timestamp from the Professional plan up, so the integrity the Canada Evidence Act asks about is proven from the file rather than from memory.

An evidence package whose proofs survive even if our company disappears. Self-verifiable cryptography, no vendor lock-in, no “trust us” required.

Tamper-evident cryptographic evidence built for court: hash, signature, blockchain timestamp, video of the capture, Provenance Certificate. One click.

ProofSnap is a Chrome & Edge extension that captures web pages as court-admissible evidence in one click. Three capture options: single page, multi-tab browsing session (with per-tab forensic packages), or signed video proof (Auto, Manual, or Session-wide screen recording). Every capture includes a SHA-256 cryptographic hash and an RSA-4096 digital signature, with a Bitcoin blockchain timestamp via OpenTimestamps from the Professional plan up, and a Provenance Certificate with 6 integrity checks for deepfake detection. In Canada, this answers the two questions the Evidence Acts actually ask. Section 31.1 of the Canada Evidence Act puts the burden of proving authenticity on whoever tenders the electronic document, and section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system that recorded or stored it. Section 31.3 proves that integrity, in the absence of evidence to the contrary, on evidence capable of supporting a finding that the system was operating properly at all material times. The common law provinces have their own Evidence Acts drafted from the same uniform model, so the wording changes but the question does not: under section 34.1 of the Ontario Evidence Act the best evidence rule is satisfied on proof of the integrity of the electronic record, and reliable encryption is expressly recognized as a way of supporting that integrity. Quebec is a civil law jurisdiction and runs on different rules of proof. Our guide to tribunal and small claims evidence works through the filing deadlines in detail. The same signed package strengthens a Landlord and Tenant Board or Civil Resolution Tribunal filing, a responding record on a section 137.1 anti-SLAPP motion, an intimate image protection order application, or a report to the Canadian Anti-Fraud Centre. Enterprise plans add eIDAS-qualified timestamps issued by Disig a.s., a Qualified Trust Service Provider on the EU Trusted List, for extra international weight. Evidence packages also line up with the rules of evidence in the United States and England and with eIDAS in the EU.

Pricing starts at $8.99/month with a 7-day free trial requiring a credit card. Used by lawyers, STR hosts, copyright enforcement firms, and compliance teams across common law and civil law jurisdictions.

Why screenshot evidence gets challenged

A screenshot is not excluded simply because it is a screenshot. It is refused when nobody can tie it to a source or a time, or show that the system it came from was working. Canadian law puts that gap in writing: the burden of proving authenticity is on the party tendering the document.

“System integrity is an admissibility issue,” and the test for establishing it is a low one.
Newfoundland and Labrador Court of Appeal, R. v. Martin, 2021 NLCA 1. The Court held that a screenshot is not inadmissible simply because it is a screenshot: what has to be authenticated is the post it depicts, and what has to be shown is the integrity of the system that recorded and stored it. In that case the police could speak only to the screenshots, not to the system behind them. A ProofSnap package carries that system evidence in the file.

No timestamp proof

File timestamps can be changed in seconds. Courts know this. Without a blockchain or eIDAS-qualified timestamp, you can’t prove when you captured it.

No tampering detection

Any screenshot can be edited with AI. In Mendones v. Cushman & Wakefield (Alameda County Superior Court, September 9, 2025), a California case, and no authority here, the claim was dismissed with prejudice after the judge found the plaintiffs had filed AI-altered videos and images. Without a SHA-256 hash, there’s no way to prove yours is real.

No chain of custody

Who captured it? When? On what device? How was it stored? A screenshot answers none of these questions. Under section 31.1 of the Canada Evidence Act, an electronic document has to be authenticated by whoever tenders it.

Your screenshot

  • 1 JPEG file, no proof it's real
  • No timestamp, could have been taken anytime
  • Editable in an image editor, leaving no trace
  • Nothing in the file answers “how do we know this is real?”

ProofSnap evidence package

  • Up to 15 files, screenshot, HTML, metadata, forensic log
  • Blockchain timestamp, immutable proof of when
  • Video of capture + Provenance Certificate
  • Chain of custody, built for the integrity test

Built for how disputes start in Canada

Capture it before they delete it

Most Canadian disputes never reach a superior court. They start at the Landlord and Tenant Board, at the Civil Resolution Tribunal, in Small Claims Court, or with a post that disappears the moment someone lawyers up. The Canadian Anti-Fraud Centre logged a record C$704 million in reported losses in 2025, and says only 5 to 10% of fraud is reported at all. Whether you are filing inside a 7-day tribunal deadline, answering an anti-SLAPP motion, or applying for a takedown order, ProofSnap locks the record in seconds, with a signed PDF and a SHA-256 hash that holds up when the other side says “that screenshot is fake.”

LTB, CRT & small claims

Tenancy, building and consumer disputes are decided on listings, inspection photos and message threads. At the Landlord and Tenant Board every party files the evidence it intends to rely on at least 7 days before the hearing, and responding evidence at least 5 days before. Late material may be refused. A landlord or seller who claims the listing never said that is much harder to believe once you produce a hashed, timestamped capture. See the detail in our guide to tribunal and small claims evidence deadlines.

Defamation: anti-SLAPP comes first

A defendant can move early under section 137.1 of the Courts of Justice Act to dismiss a claim arising from expression on a matter of public interest, and the burden then flips to you: substantial merit, no valid defence, and harm outweighing the public interest in the expression, all before discovery. Capture the post, the account and the reach while the page is live, because a deleted post is a deleted case. See our guide to defamation and anti-SLAPP evidence.

Intimate image takedown orders

British Columbia lets you apply online to the Civil Resolution Tribunal for an order that an intimate image be deleted, de-indexed or removed, and since March 18, 2026 you can seek up to C$75,000 in compensation rather than C$5,000. The order does its job, but it also takes your proof offline. Capture it first, apply second, as explained in our guide to intimate image takedown evidence.

Investment, romance & job fraud

Investment fraud accounted for C$351 million in reported losses in 2025, romance and relationship fraud for C$63.3 million and job fraud for C$50.6 million, in a record year with C$704 million reported in total. Lock the listing, the price, the promised delivery, the fake dashboard and the chat before the account disappears, so your bank dispute and your CAFC report rest on the same signed package. Our guide to fraud evidence for the CAFC sets out what to capture and in what order.

Just one dispute? You do not need a subscription.

If you are dealing with a single scam or one bad actor, a one-off SnapPack is a single up-front purchase, with no subscription, no auto-renewal, and no trial. Or send us the link and our team captures the court-ready package for you, no install required.

Three vendor approaches. One critical difference.

Most web-evidence tools force you to depend on them. ProofSnap evidence is self-verifiable: anyone with the ZIP can confirm authenticity using open standards (SHA-256, OpenTimestamps, eIDAS), with or without ProofSnap continuing to exist.

ProofSnap Page Vault / Pagefreezer Notary / Wayback Machine
Verifiable without the vendor? Yes, SHA-256 + OpenTimestamps work forever No, verification requires their portal No, depends on archive availability
What if the vendor disappears? Evidence still valid Evidence becomes hard to defend Wayback can be wiped on request
Independent court-expert verification Any IT expert, in 60 seconds Requires vendor cooperation Requires manual screenshot
Cryptographic proof in the file itself Yes, open standards (SHA-256, OTS, eIDAS) Proprietary format None

Video of Capture

capture_video.webm

Screen recording included in the evidence package, three modes:

  • Auto: records the capture process (about 60 seconds), page scroll, screenshots, metadata extraction.
  • Manual: press Start before playing media on the page (live stream, infringing video, deepfake), then press Stop & Capture when you are done. Up to 5 min on Essential / Professional, 10 min on Enterprise / Company, 75 min with a Video SnapPack credit.
  • Session: multi-tab. Records continuously while you browse across multiple tabs, then bundles a per-tab forensic package for every visited tab (full-page screenshot, HTML, DOM, DNS, WHOIS, TLS, signed evidence.pdf) into one signed ZIP.

All three modes hash the recorded video into the signed manifest, so any single-frame change breaks the signature. Available on all plans.

SESSION CAPTURE

Multi-tab forensics in one ZIP

Record across tabs. Every visited http(s) tab gets its own forensic folder (screenshot, HTML, DOM, DNS, WHOIS, TLS, signed evidence.pdf) inside a single signed, blockchain-timestamped ZIP with a session-wide video.

Use cases: multi-platform fraud, IP theft across domains, employment claims, regulator portal audits.

How a Canadian court tests your evidence

Canadian law presumes nothing about your screenshot. Under section 31.1 of the Canada Evidence Act the burden of proving authenticity sits on whoever tenders the electronic document, section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system, and section 31.3 proves that integrity in the absence of evidence to the contrary. A ProofSnap package exists to put that integrity evidence in the file.

Three questions decide whether an electronic document gets in, and they are asked in this order.

  1. Is it what you say it is? You tender the document, so you carry the burden of authenticity, and you discharge it with evidence capable of supporting a finding. A SHA-256 hash and an RSA-4096 signature over the whole package are that evidence.
  2. Can you satisfy the best evidence rule? For an electronic document that turns on the integrity of the system that recorded or stored it, not on producing an original. The chain of custody and the forensic log describe that system, step by step.
  3. Is that integrity proven? Absent evidence to the contrary, it is proven on evidence capable of supporting a finding that the system was operating properly at all material times. A Bitcoin timestamp and an offline-verifiable manifest let the other side check that themselves.

With a ProofSnap package

  • A SHA-256 hash and an RSA-4096 signature show the file has not changed since capture
  • An RSA-4096 signature, a reliable encryption technique of the kind section 34.1(5.1) of the Ontario Evidence Act names as a way of supporting integrity
  • A chain of custody the operator can attest to in an affidavit, which the Act expressly permits
  • Verifiable offline by the other side, with no call back to us
  • Dual timestamp: Bitcoin blockchain, plus an eIDAS qualified timestamp for international weight

With a plain screenshot

  • Nothing inside the file records when it was made
  • Integrity has to be proven from testimony alone
  • No record of the device, the browser or the state of the page
  • The other side has nothing it can verify independently
  • A deepfake objection has nothing to test against

eIDAS qualified timestamps are issued by Disig a.s., a Qualified Trust Service Provider on the EU Trusted List. The Article 41(2) presumption is a rule of EU law and does not bind a Canadian court; what it adds here is documented, independently checkable proof of the time. Verify on EU Trusted List.

Two layers of evidence law, one question

Canada has a federal Evidence Act and the common law provinces have their own, most of them drafted from the same uniform model. Quebec is different: proof there runs on the Civil Code and on Quebec's own information technology statute. The statute that applies depends on the court, but the question they put to an electronic document is the same one, and it is unusually close to what a cryptographic capture is designed to answer.

Authenticity is your burden

Section 31.1 of the Canada Evidence Act puts the burden of proving authenticity on the party seeking to admit the electronic document, by evidence capable of supporting a finding that it is what it is purported to be. Nobody has to disprove your screenshot. You have to prove it.

Best evidence turns on system integrity

Section 31.2 satisfies the best evidence rule on proof of the integrity of the electronic documents system that recorded or stored the document. Section 31.3 proves that integrity, absent evidence to the contrary, on evidence capable of supporting a finding that the system was operating properly at all material times.

The provinces mirror it

section 34.1 of the Ontario Evidence Act satisfies the best evidence rule on proof of the integrity of the electronic record, and expressly allows that integrity to be supported by evidence that reliable encryption techniques were used. Other provinces follow the same uniform model.

Tribunals are looser, deadlines are not

The Landlord and Tenant Board and the Civil Resolution Tribunal do not apply the rules of evidence strictly, but the LTB will refuse late material: 7 days before the hearing for the evidence you rely on, 5 days for responding evidence, and uploading to the portal does not count as serving the other party.

Where eIDAS fits in Canada: Canada has no equivalent of the European qualified timestamp regime, so our eIDAS timestamp carries no automatic presumption in a Canadian court or tribunal. It is corroboration from an independent, audited third party, not a legal shortcut. What does the work here is the hash, the signature and the blockchain anchor, all of which anyone can verify without trusting us.

Prices are charged in USD. The approximate Canadian figure shown under each price is for orientation only, converted at about C$1.40 to US$1. Your card issuer sets the actual rate on the day. The 7-day trial requires a credit card. Prefer not to subscribe? A one-off SnapPack is a single up-front purchase, with no subscription, no auto-renewal and no trial.
